1. Acceptance of Terms

By accessing or using TheFacilityApp ("the App", "we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms apply to all users, including athletes, coaches, administrators, and parents.

2. Description of Service

TheFacilityApp is a sports performance and recruiting intelligence platform designed to help athletes, coaches, and facilities track athletic performance, generate training programs, and manage recruiting profiles. Features include performance assessments, AI-generated training recommendations, recruiting intelligence reports, and multi-sport analytics.

3. User Accounts

To use the App, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account
• Not share your account credentials with others

4. Subscription Plans and Billing

TheFacilityApp offers subscription-based access. By subscribing, you agree to:

• Pay all applicable fees for your selected subscription plan
• Automatic renewal of your subscription unless cancelled before the renewal date
• Our refund policy, which is handled on a case-by-case basis
• Price changes with at least 30 days advance notice

Payments are processed securely through Stripe. We do not store your payment card information.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any regulations
• Upload or transmit any harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to any part of the App or its systems
• Reverse engineer, decompile, or disassemble any part of the App
• Use automated tools to scrape, crawl, or extract data from the App
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the integrity or performance of the App

6. Athlete Data and Privacy

We take the privacy of athlete data seriously, especially for minors. Coaches and facility administrators who input athlete data represent that they have appropriate authorization to do so. All athlete data is handled in accordance with our Privacy Policy.

7. Intellectual Property

All content, features, and functionality of TheFacilityApp — including but not limited to the Explosive Power Score (EPS) methodology, Basketball Athlete Intelligence Score (AIS), AI-generated training programs, and recruiting intelligence algorithms — are owned by TheFacilityApp and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. AI-Generated Content

The App uses artificial intelligence to generate training recommendations, recruiting projections, and performance analyses. These outputs are provided for informational purposes only and should not be considered professional medical, training, or recruiting advice. Always consult qualified professionals before making significant training or health decisions.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Performance projections and recruiting intelligence outputs are estimates only and are not guarantees of athletic or recruiting outcomes.

10. Limitation of Liability

To the maximum extent permitted by law, TheFacilityApp shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of revenue, or personal injury resulting from reliance on App-generated content.

11. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in conduct we deem harmful to the App or its users. You may cancel your account at any time through the billing settings. Upon termination, your access to the App will cease, though we may retain certain data as required by law.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notification. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with applicable arbitration rules.
